These Terms and Conditions govern your use of the Hei Lok website and, where applicable, your arrangements with us regarding residential and lifestyle services. Please read them at your own pace. If you have any questions before proceeding, we welcome your call or message — we are always glad to explain anything in plain terms.
1. Definitions
Throughout these Terms, the following words carry the meanings set out below:
- "Hei Lok" / "we" / "us" / "our" — Hei Lok, a senior living residence located at 142 Argyle Street, Kowloon Tong, Kowloon, Hong Kong.
- "Website" — the pages and content hosted at our registered domain, including all sub-pages.
- "Services" — the residential, dining, garden, housekeeping and community offerings described on this Website and in any written service agreement.
- "Resident" — a person who has entered into a formal residency arrangement with Hei Lok.
- "Visitor" / "User" / "you" — any person browsing or using this Website, or enquiring about our Services, whether or not they become a Resident.
- "Agreement" — these Terms and Conditions, together with any separate written residency or service agreement signed between Hei Lok and a Resident or their authorised representative.
- "Content" — all text, images, photographs, logos, layouts and other material published on the Website.
2. Acceptance of Terms
By using this Website, submitting an enquiry form, or entering into a service arrangement with us, you confirm that you have read and understood these Terms and agree to be bound by them.
Where a Resident lacks capacity to enter into agreements independently, a family member or authorised representative may act on their behalf, provided appropriate authority (such as a power of attorney or equivalent) is established. We will handle such arrangements with sensitivity and respect.
Persons under the age of 18 may browse this Website, but any formal service enquiry or agreement must involve a parent or guardian. Our Services are designed for residents aged 60 and above, though enquiries from families acting on behalf of a loved one of any age are welcome.
3. Our Services
Hei Lok offers a non-medical senior lifestyle residence in Kowloon Tong, providing a calm and well-supported living environment for older adults. Our current service offerings include:
- Shared Dining and Tea House — three home-style meals daily plus afternoon dim sum tea, at HK$1,080 per month.
- Garden and Courtyard Mornings — daily access to landscaped gardens and shaded courtyards, at HK$2,260 per month.
- Full Comfort Residence Package — private furnished room with housekeeping, laundry, errand help and all dining and garden services, at HK$3,880 per month.
Services are available to residents in Hong Kong. We do not currently offer remote or online-only arrangements. Service availability may vary from time to time, and we will communicate any material changes with reasonable advance notice.
Hei Lok is a lifestyle residence, not a medical facility. We do not provide nursing care, clinical treatment or medical supervision. If you require such services, we are happy to help identify suitable resources in the community.
4. Residency Arrangements
Becoming a resident at Hei Lok involves a separate written residency agreement signed by both parties. An enquiry through this Website or by telephone does not in itself create any legal obligation for either party.
Upon agreeing to join, we will ask for a completed application form, relevant health and personal information (handled in accordance with our Privacy Policy), and any necessary family or representative authorisation. We take time to ensure a comfortable welcome for every new resident.
Account or resident profile information is managed by Hei Lok staff on your behalf. If you wish to update or correct any information we hold about you, please speak with us directly — we are always available during office hours.
5. User Responsibilities
We ask that all visitors to our Website and all residents or their representatives use our services and communications in good faith. In particular, we ask that you:
- Provide accurate and truthful information when completing enquiry forms or residency applications.
- Treat our staff, other residents and visitors with courtesy and respect.
- Use the Website only for lawful purposes and in a manner that does not infringe the rights of others.
- Refrain from submitting content that is offensive, misleading, abusive or in breach of any applicable law.
- Not attempt to access parts of the Website or its underlying systems without authorisation.
- Observe any house rules applicable to residents, which will be provided in written form upon joining.
We understand that situations can be complex, particularly when families are navigating care decisions for a loved one. Our team is here to support you through the process with patience and understanding.
6. Intellectual Property
All Content on this Website — including text, photographs, logos, page layouts and design elements — belongs to Hei Lok or is used with appropriate permission. You are welcome to read and share links to our pages, but you may not copy, reproduce or adapt our Content for commercial purposes without our written consent.
We grant you a limited, personal, non-exclusive licence to view the Website and print pages for your own reference — for example, to share information with a family member who is considering a move to Hei Lok.
Where you share photographs, messages or other material with us (for example, via our contact form or directly with staff), you confirm that you hold the necessary rights to do so and that the material does not infringe the rights of any third party.
7. Payment Terms
Fees for our services are as published on our Website and confirmed in writing at the time of any service agreement. All fees are quoted in Hong Kong Dollars (HKD). Payment is due monthly in advance on the date agreed upon in the residency arrangement.
We accept payment by bank transfer, cheque or such other methods as may be agreed. Full payment details will be provided upon entering into an arrangement with us.
We understand that circumstances can change. Where a resident or family member needs to discuss payment timing or adjustments, we ask that you speak with us at the earliest opportunity so we can consider your situation kindly and practically.
Refund arrangements — for example, where a resident departs before the end of a payment period — will be addressed on a case-by-case basis in accordance with the written residency agreement and applicable Hong Kong law.
8. Service-Specific Terms
Each of our service arrangements carries the following general conditions:
8.1 Dining and Tea House
Menus are planned seasonally and may vary based on ingredient availability. While our kitchen team is attentive to personal tastes, Hei Lok is not a clinical food service and cannot guarantee provision for all dietary medical requirements. Residents with specific dietary needs should discuss these with our team before commencing.
8.2 Garden and Courtyard Access
Garden and outdoor areas are available during daylight hours, weather permitting. Temporary closures may occur for maintenance or safety reasons, and we will provide reasonable advance notice wherever possible.
8.3 Full Comfort Residence Package
Private rooms are allocated based on availability at the time of arrangement. Room specifications, furnishings and dimensions will be confirmed in writing. Residents are welcome to personalise their room with personal items within reasonable guidelines. Housekeeping and laundry services are delivered according to a schedule agreed upon with each resident, and we are flexible in working around individual preferences where we can.
9. Disclaimers
The information on this Website is provided in good faith for general guidance. While we aim to keep it accurate and up to date, we cannot warrant that it is complete or free from error at all times. We recommend confirming specific details with us directly before making any decisions.
Hei Lok is a lifestyle residence and does not provide medical, nursing, clinical or therapeutic services. Nothing on this Website constitutes medical advice, and we encourage residents and families to consult qualified healthcare professionals for all health-related matters.
Our Website may contain links to external websites for your convenience. We do not control the content of those sites and accept no responsibility for their accuracy or conduct.
10. Limitation of Liability
To the extent permitted by Hong Kong law, Hei Lok's liability in connection with the Website or our Services is limited to direct losses only. We will not be liable for any indirect, consequential or special damages, loss of profit, or loss of opportunity arising from the use of or inability to use our Website or Services.
Where any liability is established under applicable Hong Kong law, our total liability shall not exceed the fees paid by the affected Resident in the calendar month in which the relevant matter arose.
We are not liable for any disruption or failure of Services caused by circumstances beyond our reasonable control, including typhoons, government orders, power outages, public health emergencies or other force majeure events. We will do our utmost to communicate and make appropriate arrangements for residents during any such period.
11. Indemnification
You agree to indemnify and hold harmless Hei Lok, its staff and representatives against any reasonable claims, costs or expenses arising from your breach of these Terms, your misuse of the Website or our Services, or any false or misleading information you have provided. This provision applies to Users, Residents and their authorised representatives as appropriate.
12. Termination
Either party may bring a service arrangement to a close by giving reasonable written notice as specified in the applicable residency agreement. We ask for a minimum of 30 days' written notice where a Resident or their representative wishes to conclude an arrangement, though we will always try to accommodate circumstances that require a shorter timeline.
Hei Lok reserves the right to end a service arrangement where a Resident or their representative has materially breached these Terms or the applicable residency agreement, or where continuing the arrangement would compromise the safety or wellbeing of other residents or staff.
Upon termination, any outstanding fees remain payable. Provisions in these Terms relating to intellectual property, disclaimers, limitation of liability and dispute resolution continue to apply after any termination.
13. Dispute Resolution
These Terms are governed by and interpreted in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute shall be subject to the non-exclusive jurisdiction of the courts of Hong Kong SAR.
We greatly prefer to resolve any concern through open and friendly conversation. If you have a concern, we ask that you contact us first at [email protected] or by telephone, so that we may discuss it together and find a considerate resolution.
Where informal resolution is not possible, the parties may agree to seek independent mediation before pursuing formal proceedings. Nothing here prevents either party from seeking urgent relief from a court where circumstances require it.
14. General Provisions
- Entire Agreement. These Terms, together with any signed residency agreement, form the complete understanding between the parties regarding the subject matter herein and supersede any prior discussions or representations.
- Severability. If any provision of these Terms is found to be unenforceable under Hong Kong law, that provision shall be modified to the minimum extent necessary, and all remaining provisions shall continue in full force.
- Waiver. Our failure to enforce any right under these Terms on a particular occasion does not constitute a waiver of that right on any future occasion.
- Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may transfer our obligations to a successor organisation, in which case we will notify you in advance.
- Notices. Formal notices to Hei Lok should be directed to our postal address or to [email protected]. We will direct formal communications to the address provided by you in your residency application or enquiry.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements or good practice. When we do, we will update the "Last Updated" date at the top of this page and, where changes are material, we will provide reasonable advance notice to current Residents by letter or email.
Your continued use of the Website or our Services following any update constitutes your acceptance of the revised Terms. If you have any concern about a change, please do not hesitate to speak with us.
